An individual who administers a trust or estate owes fiduciary duties to the beneficiaries of that trust or estate. For example, a trustee of a trust has a duty to administer the trust according to its terms, a duty of loyalty, a duty of impartiality, a duty to avoid self-dealing and to use ordinary care in administering the trust, among other duties.
If a fiduciary of a will or trust breaches his or her duties, the law provides a wide range of remedies to redress the breach, including but not limited to, damages and/or removal of the person from the fiduciary position.
