One of the most important decisions people make is how they wish to leave their assets upon their death. It is a fundamental right to choose how one wishes to dispose of his/her property. This decision forms part of a person’s legacy, a gift for the benefit of their family, friends or perhaps a cause they believe in.
On occasion, a person’s testamentary plan is thwarted through wrongful conduct. For example, vulnerable adults can be subjected to undue influence, fraud and/or coercion, or may lack capacity, which upends the inheritance they wish to leave.
The law provides a remedy against this type of wrongful conduct. But litigating disputes involving an individual’s estate plan is complicated and time-consuming.
Our office firmly believes that elderly and vulnerable adults must be protected, even after their passing. We recognize how important testamentary gifts can be to a beneficiary. Our firm has successfully taken to trial cases involving challenges to testamentary instruments. We would be happy to speak with you about such a matter.
